TERMS AND CONDITIONS

Please take time to read the terms and conditions of Broadbill Safaris Uganda services. Confirming a safari with Broadbill Safaris assumes that you have read, fully understand and accept the terms and conditions as described below.

BOOKINGS

All information detailed in client itineraries is given to the best of Broadbill Safaris Uganda knowledge and based on the latest information available. Broadbill Safaris Uganda cannot be liable for modified information from third parties, nor for any obvious typing errors.

To reserve flights and gorilla and chimpanzee permits we need: your names as they appear in passport, your nationality and passport number.

Before confirming a safari, the client must inform Broadbill Safaris Uganda of any preferences and special requests of the participants; e.g. medical needs, diet, requirements relating to disabilities and any requirements. Broadbill Safaris Uganda will meet the requests if possible.

All packages are subject to availability and not guaranteed until confirmed. Many lodges and hotels offered by Broadbill Safaris Uganda have limited capacity and therefore it is essential to make reservations well in advance of your planned trip.

In the event that you wish to amend your reservation in any way, Broadbill Safaris Uganda will make the preferred adjustment where practicable and possible and confirm accordingly. Broadbill Safaris Uganda reserves the right to charge an amendment fee relative to the actual costs, which will be added to the total invoice.

Broadbill Safaris Uganda reserves the right to change and re-adjust the tour schedule, transportation, accommodation and services indicated in the itinerary in the event of unforeseen circumstances before arrival. Any changes to the itinerary will be communicated to the client as soon as possible.

PRICES

The prices quoted for the various safaris are as per the itinerary and include the following services, unless stated otherwise: overnight in guesthouses, hotels, lodges, camps or tents, all meals as indicated, sightseeing as detailed in the itinerary, park entrance fees and ranger fees, airport transfers where applicable, ground transportation, English speaking driver/guides and bottle mineral water in the vehicle.

Prices on the websites or quoted to our clients are subject to change without notice and are not guaranteed until confirmed in writing

Expenses that are not covered: international and domestic airfares, visas and passports, meals not mentioned in the itinerary, drinks other than the mineral water provided in the vehicle, tips and gratuities for the guides and accommodation staff, laundry, travel insurance and other items of personal nature.

Broadbill Safaris Uganda reserves the right to adjust prices at any time should there be any fluctuation in the exchange rate or increase in the cost of any element of the tour. The company will however make every effort to minimize any increase.

EXECUTIONS OF THE TOUR

It is a privileged to see animals in their natural habitat and as such, we cannot guarantee wildlife or game viewing. You must take caution when viewing the animals and carefully follow the instructions given by either the tour guide or wildlife rangers.

A gorilla or chimpanzee permit guarantees clients will be able to track the primates in question but does not guarantee that the animals will be in plain sight.

Accommodation is based on a twin- or double-bedded room, tent or banda, with private bathroom where possible. Single rooms may be available with the payment of a supplement fee but availability cannot always be guaranteed.

Broadbill Safaris reserves the right to substitute equivalent or superior hotels. If a hotel of equivalent standard is not available Broadbill Safaris may substitute the next best quality hotel or suggest superior standard accommodation (extra charges may apply).

The mode of transport used will be dependent on the number of clients and the route taken, based on the specifications of the chosen itinerary. Every effort is made to ensure that vehicles re provided in a roadworthy condition but no liability can be accepted for a puncture, breakdown, damage, or any delay as a result of the poor road conditions.

Experienced English-speaking driver/guides are a key part of your tour. They are the only persons allowed to drive Broadbill Safaris vehicles. The driver’s decision on all matters, such as the route taken is final.

Broadbill Safaris reserves the right to alter any route or arrangement, to cancel the operation of any scheduled tour or vary the safari services in anyway in the event of unforeseen circumstances, such as road closures, bad weather, problems with national parks, or hotels and security consideration. In such cases, alternative arrangements will be made as circumstances permit.

Broadbill Safaris reserves the right to employ subcontractors to carry out all or part of the services agreed to be supplied.

Broadbill Safaris reserves the right to refuse any person from participating or continuing any tour if, in Broadbill Safaris opinion or in the opinion of any other person in authority, the person concerned behaves in such a way as to cause or be likely to cause danger, hazard or inconvenience to any third party, damage to property or to environments and ecosystems. No refunds will be made and Broadbill Safaris shall not be liable for expenses incurred as a result of the termination.

PAYMENT

All tours will be booked and confirm only upon receipt of a 30% deposit of the basic program rate. For gorilla permits, a full advance payment of the permit fee is required in order to make the reservation.

The payment balance is due no later than 42 days prior to the safari, unless agreed otherwise.

Bookings made within 42 days before arrival must be paid in full at time of confirmation.

If payment is not received in accordance with the above, Broadbill Safaris has the right to cancel the booking.

Payment can be made by VISA credit card, bank transfer or cash at least USD, EURO, GB pound sterling, before the start of the safari. Note that payments by VISA credit card attracts a 5% service charge. Credit card transactions must be made at least two months prior to the start of your safari. Regretfully, traveler cheques are no longer accepted.

The cost of international transactions (or 5% service charge in case of credit card payments) are to be fully paid by the client.

ACCOMMODATIONS

We use elegant and very suitable hotels/camps/lodges/tents which are very attractive with good facilities, hot water, friendly staffs and reasonable prices. It’s on that note that we request all our clients to advise if they any dietary requirements in advance. We reserve the right to alternate equivalent or superior hotels in regard to your booking.

CANCELLATIONS AND REFUNDS

All cancellation requests must be in writing and shall be effective on the date of actual receipt by Broadbill Safaris.

The following cancellation charges apply to the basic program rate:

60 days or more prior to arrival   10% charge

59 – 32 days prior to arrival          25% charge

31 – 8 days prior to arrival             50% charge

7 – 3 days prior to arrival               75% charge

48 hours or less prior to arrival        100% charge

Broadbill Safaris reserves the right to deduct all expenses incurred from money paid.

Gorilla, chimpanzee permits and air tickets are 100% non-refundable

We do not refund for any unused services, late arrival or no-show of any of the members of the tour.

However, we irregularly cancel confirmed bookings, but we must reserve the right to do so. We always try to avoid cancelling of already confirmed bookings.

 We shall not cancel your holiday less than 60 days before departure unless we are forced to do so as a result of unusual and unforeseeable conditions beyond our control, the consequences of which we could not have avoided even with all due care. If we cancel your tour (except where you have failed to make payment or as a result of force majeure) we shall offer you the choice of purchasing an alternative tour from us of a similar standard to that originally booked if available. If the chosen alternative is less expensive, we shall refund you the difference. Alternatively, you are entitled to a full refund of all monies you have paid to us save that paid for gorilla permits which can only be refunded if the refund has been made available to us.

Please note that cancellation fees are based on the date of your written notification is received at Broadbill Safaris.

AGE REQUIREMENTS

Anyone under the age of 10 years on the date of the safari is considered to be minor

Minors must always be accompanied by an adult.

One adult may accompany up to two minors. The minimum age to be on our safari tour is 3 years.

If the consent of a parent, guardian or any other person is required by the applicable laws of that country, the accompanying adult is responsible for securing all consents, documentation and ensuring that the minors meet all the legal requirements to travel on our safari tour.

We shall not be liable for any fees, damages or losses incurred as a result of any failure to secure necessary consents, permits and all approvals.

Each adult on our tour with a minor (s) is jointly and severally responsible for the behavior, well being, supervision, and monitoring of such minor (s) and jointly and severely accept these terms for and on behalf of any such minor (s) including all assumptions of risk and limitations of liability.

COMPLAINTS

Broadbill Safaris shall try to ensure that we exceed the expectations in every area of our tour arrangements, regardless, suggestions are very much welcome in order to ensure better and quality service delivery.

Any complaints must be reported immediately to the Broadbill Safaris offices or the representative and to the supplier of the service in question, who will do their best to resolve the matter at hand. If the problem is not resolved to the client’s satisfaction, a written complaint should be made not later than 30 days after completion of the tour.

Liability for any complaints not notified in accordance with the above-described procedure cannot be accepted.

LIABILITY

Broadbill Safaris will make every measure to ensure that all arrangements and services offered are carried out as specified in the most efficient and effective way possible.

However, the company does not have direct control of services provided by suppliers and whilst every supplier is chosen with utmost care and we shall not accept liability for errors or omissions by such suppliers.

We shall also not be liable for any loss, damage or injury of any nature whatsoever whether to person or to property.

Whilst every care is taken, Broadbill Safaris cannot be held responsible for the direct or indirect costs of loss or damage to baggage or personal possessions.

Broadbill Safaris cannot accept liability or pay compensation for unforeseen circumstances beyond the control of the company or its staff, including flight delays/cancellations or force majeure such as war or threat of war, extreme weather conditions, riots, civil strife, boarder closures, strikes, epidemics, fire, technical/mechanical problems to transportation, theft pirates, and all similar events beyond our control.

INSURANCE

It is the client’s responsibility to make sure that they have sufficient coverage with travel insurance.

HEALTH

It is the responsibility of the client to ensure that proper medical precautions (immunizations and so on) have been taken.
